• "Hi Steve,   Yes, according to our Lawyer, we must wait one (1) year from date of death dd/mm/2022 to dd/mm/2023 for Creditors to come forward to make any claim(s) against the Estate.  We told our Lawyer, some of Z's brothers were   pressuring us to pay funds out of the Trust now, and not wait the one (1) year (the brothers think there will be only small bills due, and want us to leave only about $0,000 in the Trust Account for anything that comes up) before disbursing the funds? Z's Mom J, did not have much debt, just household bills and two small credit cards.   Our Lawyer said we may be able to make "partial payments" to Z’s brothers now, and to leave the Trust Account open for one (1) year (for Creditors) then pay remaining funds to the Heirs after the one (1) year deadline.  This is an IRREVOCABLE TRUST, not an Estate going through Probate, so the process is easier and quicker  As I understand from both you, and the Lawyer the following must occur to settle the Estate.
  1. File a Final Tax Return for J, - Social Security Form SSA-1099 is not available until January of 2023 (Z's Mom only received a small amount of money back, never owed IRS).  Low income household.
  2. Pay any Debts owed by the Estate, give Creditors time to send them to us (we have only two Credit Cards to pay so far).
  3. Keep records of all Income and Expenses for the Trust account. The funds are in a Non-Interest bearing account.
  4. The Trust will have to File a Form 1041 for any income earned on the Trust, which we believe will be deminimis? 
  5. Distribute assets to Heirs after one (1) year from daste of death has passed.
  • I’m updating a list of all bills that have been paid so far, so we have accurate records when it’s time to settle it all.   Regarding Z's Mom's Estate, Z spoke with a second Estate Lawyer to appease his brothers, and the lawyer said we could pay his brothers approximately $000K each out of the Estate and to leave the last $00K as a compensating balance until after Z’s Mom’s 2022 Final tax return is filed and then one (1) year after Mom's date of death (dd/mm/2023), until the remainder of the funds can be paid out to Z’s brothers.  Hopefully this will diminish stress for all parties involved?  Any advice you can offer is appreciated Steve.  I trust your honesty & integrity.  Thank you for all your help and input.  We appreciate your assistance and you as well."

Now I am very near being completed although not yet since I still need to deal with the state stuff and I still need to do a little bit more work on the Federal but I am so much more calm and less terrified. I think with the accrual method I am caught up in terms of federal payments I did not owe any money yesterday which is awesome. This has literally been causing so much stress and paralysis for all these years. I don't move forward with lots of things like looking for a better job because I think first I need to take care of taxes. It's a huge thing in my life and it's amazing to be less terrified and I might even finish it in the near future which is just astonishing.  I can't begin to tell you how grateful I am that you picked up the phone 6 months ago and how much help you've given me since then. I was really terrified and I didn't know what to do about the mismatch in 1099 timing it wasn't at all clear how to handle that?  Every time I think about this I am infinitely grateful for the amazing luck of catching you that day on tax day!  And getting invaluable help. Do you know how [muffed up] I would have been? I was literally going to mismatch the numbers from my 1099s in order to do an accrual without knowing of the concept of adjustments...
